CONDITIONS GÉNÉRALES D'UTILISATION - TERMS AND CONDITIONS OF USE -

Les présentes conditions générales d’utilisation (ci-après « CGU ») définissent les conditions dans lesquelles le Comité Régional du Tourisme Bourgogne-Franche-Comté (ci-après le « CRT ») autorise, de façon non-exclusive, l’utilisateur de la médiathèque (ci-après l’« Utilisateur ») à reproduire et/ou représenter les médias accessibles à l’adresse Internet http://mediatheque.franche-comte.org/crtfc/ (ci-après les « médias »).

En acceptant les CGU, l’Utilisateur reconnaît avoir pris connaissance et accepter explicitement et sans réserve les stipulations des CGU et, en conséquence, l’Utilisateur s’engage à respecter les CGU intégralement.

1. Autorisation d’utilisation des médias consentie par le CRT aux Utilisateurs.

1.1. Le CRT autorise, à titre gratuit et non-exclusif, l’Utilisateur à reproduire et à représenter les médias sous réserve du strict respect par l’Utilisateur des conditions définies ci-après.

1.2. L’Utilisateur s’engage à exploiter les médias dans le strict cadre de la promotion et de la valorisation, en France ou à l’étranger, de la destination touristique Bourgogne-Franche-Comté.

1.3. L’utilisateur s’engage à transmettre les justificatifs de publications au CRT à l’adresse : Bourgogne-Franche-Comté Tourisme – 5, avenue Garibaldi - 21000 Dijon ou par mail info@bfctourisme.com

1.4. Les médias ne peuvent être reproduits ou représentés par l’Utilisateur que dans le cadre d’articles de presse ou sur des supports diffusés gratuitement au public, tels que notamment, sans que la liste ci-après ne présente un caractère limitatif, des brochures, des tracts, des dépliants, des posters, des guides, des sites Internet, réseaux sociaux.

1.5. L’Utilisateur s’engage à ne pas utiliser les médias sur des supports payants commercialisés auprès du public, tels que notamment, sans que ce qui suive ne présente un caractère limitatif, des ouvrages, des guides, des cartes postales, des posters, etc.

1.6. L’Utilisateur s’engage à ne pas utiliser les médias pour des campagnes de promotion ou de publicité avec achat d’espace.

1.7. La présente autorisation d’utilisation des médias est consentie par le CRT à l’Utilisateur à titre strictement personnel et usage unique. Il est donc interdit à l’Utilisateur de céder à des tiers, que ce soit à titre gratuit ou onéreux, le bénéfice de la présente autorisation.

1.8. L’Utilisateur s’engage à mentionner le copyright sur chacune des reproductions et/ou représentations de médias. Ce copyright est composé du nom d’auteur/réalisateur, suivi de la mention « Bourgogne-Franche-Comté Tourisme ». Il est strictement interdit à l’Utilisateur de modifier les mentions du copyright (en particulier nom d’auteur/réalisateur) associées aux médias.
1.9. L’Utilisateur s’engage à respecter le droit moral des auteurs en toute circonstance et à ne pas porter atteinte à l’honneur ou à la réputation des auteurs des médias et/ou du CRT.

2. Garantie

2.1 L’Utilisateur bénéfice d’un accès aux médias sécurisé par un identifiant et un mot de passe. L’Utilisateur s’engage en toutes circonstances à garder secrets ses identifiant et mot de passe et s’interdit de les communiquer à des tiers. L’Utilisateur est responsable de toute utilisation faite de ses identifiant et mot de passe et de toute utilisation/exploitation des médias en découlant. Dans l’hypothèse où la confidentialité des identifiant et mot de passe ne seraient plus assurée, l’Utilisateur s’engage à en informer immédiatement le CRT.

2.2. L’Utilisateur garantit le CRT contre toute réclamation ou toute action émanant de tiers qui serait engagée à l’encontre du CRT en raison d’une exploitation non autorisée des médias et/ou de la violation des CGU. En particulier, l’Utilisateur s’engage à rembourser le CRT de l’ensemble des frais (y compris d'avocats) et condamnations, résultant de cette violation, que le CRT pourrait être amené à payer et à l'indemniser de l’intégralité du préjudice subi.

3. Divers

3.1 Le CRT se réserve le droit de modifier ou de mettre à jour les CGU, à tout moment, sans préavis. La version en vigueur des CGU est affichée à compter de la date à laquelle une modification prend effet. La poursuite de l'utilisation des médias, après qu'une modification des CGU soit intervenue, constitue l'acceptation par l’Utilisateur de cette modification.

4. Droit applicable

4.1 Les CGU sont régies par le droit français.
4.2 Tout litige relatif au CGU relève de la compétence exclusive des tribunaux du ressort de la Cour d’Appel de Dijon.

These terms and conditions of use (hereinafter “TCU”) define the conditions in which the Regional Tourism Committee of Burgundy-Franche-Comté (hereinafter the “RTC”) non-exclusively authorises the user of the multimedia library (hereinafter the “User”) to reproduce and/or represent the accessible media from the Internet address http://mediatheque.franche-comte.org/crtfc/ (hereinafter the “media”).

By accepting the TCU, the User recognises having acknowledged and explicitly and unreservedly accepts the stipulations of the TCU and, consequently, the User undertakes to observe the TCU in full.

1. Authorisation for the Users to use the media agreed to by the RTC.

1.1. The RTC authorises the User to reproduce and represent the media free of charge and non-exclusively, subject to the User’s strict compliance with the conditions defined below.

1.2. The User undertakes to use the media in the strict context of promoting and developing, in France or elsewhere, the Burgundy-Franche-Comté tourist destination.

1.3. The user undertakes to transfer the supporting documents of publications to the RTC at the following address: Bourgogne-Franche-Comté Tourisme – 5, avenue Garibaldi– 21000 Dijon cedex or by email info@bfctourisme.com

1.4. The media can only be reproduced or represented by the User in the context of press articles or media that are distributed free of charge to the general public, such as brochures, leaflets, pamphlets, posters, guides, websites, and social networks (non-exhaustive list).

1.5. The User undertakes to not use the media on profitable commercialised mediums for the general public, such as books, guides, postcards, posters, etc. (non-exhaustive list).

1.6. The User undertakes to not use the media for promotional campaigns or purchased advertising spaces.

1.7. This authorisation for the User to use the media is agreed upon by the RTC for strictly personal use and for single use only. The User is therefore forbidden to transfer, whether against payment or free of charge, the benefit of this authorisation to third parties.

1.8. The User undertakes to indicate the copyright on each reproduction and/or representation of the media. This copyright should include the name of the author/producer, followed by “Bourgogne-Franche-Comté Tourisme”. The User is strictly prohibited from modifying the copyright notices (in particular the name of the author/producer) associated with the media. 1.9. The User undertakes to respect the moral right of authors in all circumstances and must not damage the honour or reputation of the media authors and/or of the RTC.

2. Guarantee

2.1 The User benefits from a secure access to the media via a user name and password. The User undertakes to keep his/her user name and password secret in all circumstances, and must not communicate them to third parties. The User is responsible for any use made of his/her user name and password and any ensuing use/utilisation of the media. Assuming that the confidentiality of the user name and password is no longer safe, the User undertakes to immediately inform the RTC.

2.2. The User guarantees the RTC against any claims or any action arising from a third party which may be taken against the RTC due to a non-authorised use of the media and/or breach of the TCU. In particular, the User undertakes to reimburse the RTC for all expenses (including lawyers’ fees) and sanctions resulting from this breach that the RTC may be required to pay, and to fully compensate them for the loss sustained.

3. Miscellaneous

3.1 The RTC reserves the right to modify or update the TCU at any time, and without prior notice. The current version of the TCU is displayed from the date on which a modification takes effect. The continuation of media use, following a modification of the TCU, requires the User’s acceptance of this modification.

4. Applicable law

4.1 The TCU are governed by French law.

4.2 Any dispute relating to the TCU is subject to the sole jurisdiction of the competent courts of the Court of Appeal of Dijon.
